District courts were established in by constitutional amendment Article V, Sections 7 and 8. District courts are the trial courts of general jurisdiction in law and equity. A constitutional district court's jurisdiction cannot be reduced by the legislature, though the legislature has established some non-constitutional courts such as criminal district courts or domestic-relations courts that have limited jurisdiction. Most district courts exercise criminal and civil jurisdiction, but in the metropolitan areas there is a tendency for the courts to specialize in either civil, criminal, or family-law cases.
A few district courts also exercise the subject-matter jurisdiction exercised by county courts. As of the state has district-level courts.
The geographic area of most judicial districts is one county, although populous counties have many district courts, and judicial districts often overlap each other. No judicial district is smaller than a county. Some judicial districts in sparsely populated areas comprise more than one county. Each court has one judge, who serves a four-year term.
In probate cases, the district court has appellate jurisdiction over the county court. In addition, the district court supervises the county commissioners court and has appellate jurisdiction over it. Historically, the district clerk had broad responsibilities that have narrowed over time due to increasing case loads. In the nineteenth century, district clerks typically heard all types of cases in the same court. The early district court case files reflect this, as they include delinquent tax, naturalization, criminal, and family law matters, such as divorce, adoption, child support, neglected children, removal of disabilities of minors, and name changes.
By , most counties separated the duties of the district court into distinct statutory courts such as family law, criminal law, and civil law. The case files document land ownership, slavery, alcohol consumption, and the purchase of consumer goods such as food, toiletries, and tobacco; economic activity, including the cotton, cattle, railroad, and lumber industries; and agricultural trends, such as sharecropping in the s and the emergence of rice production in the s. After the Spindletop oil discovery in , many aspects of petroleum production can be found in the case files, including exploration, tracts of land where workers drilled for oil, equipment used, depth of wells, industrial accidents, the price of petroleum, and methods of refining.
The divorce case files document laws and customs concerning marriage in Texas. Having irreconcilable differences was not valid grounds for a divorce until the late twentieth century; a litigant was required to prove that his or her spouse was at fault for the problems in the marriage. Alcohol abuse, prostitution, and physical and mental abuse were among the allegations made.
